Terms

1. Who we are
Eiva is a trading name of Orthyrus Ltd, a company registered in England and Wales under company number 15177133. The notes behind the vaults are issued by Eiva Receivables 1 Ltd, company number 17372071, a wholly owned subsidiary of Orthyrus Ltd.
You can contact us at partnerships@eiva.co.
2. What these terms cover
These terms govern your use of eiva.money and its pages. By using the site you agree to them. If you don’t agree, please don’t use the site.
The vaults aren’t open yet. When they open, any deposit will be governed by separate note terms, which you review and sign before depositing. If these terms and the note terms conflict, the note terms apply to that deposit.
3. No offer and no advice
Nothing on this site is an offer or an invitation to deposit, and nothing on it is investment, legal or tax advice. If you’re unsure whether a vault is right for you, take independent advice.
Vault rates are targets, not promises. Deposits are not bank deposits and are not protected by the FSCS, and your capital is at risk. The Risk page sets out what can go wrong.
4. Using the site
You may use the site for lawful purposes only. You must not:
- use it in a way that breaks any law or these terms;
- try to reach any part of it you’re not authorised to reach;
- interfere with how it runs or how secure it is; or
- copy, scrape or reverse engineer any part of it.
5. Information on the site
We take care to keep the site accurate, but we don’t promise that everything on it is complete or up to date. Comparison rates come from public sources and change often. Track record figures show what has happened so far and don’t predict future results.
6. Links to other sites
The site links to other sites, including our documentation, eiva.co and third-party services. We aren’t responsible for sites we don’t run.
7. Intellectual property
The site, its content and its branding belong to us or our licensors. You may view them for your own use. Other companies’ names and logos belong to those companies.
8. Availability
We aim to keep the site available but we don’t guarantee it. We may change, suspend or withdraw any part of it, and we’ll give notice where we reasonably can.
9. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can’t be limited or excluded by law.
Subject to that, we aren’t liable for any loss of profit, loss of business, loss of opportunity or any indirect or consequential loss arising from your use of the site. We provide the site as is, and we don’t promise it will be uninterrupted, error-free or suitable for any particular purpose.
10. Privacy
How we handle personal data is set out in our Privacy policy.
11. Changes to these terms
We may change these terms from time to time. We’ll post the new version here with a new date. If you keep using the site after a change, you accept it.
12. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them. If any part of these terms is found to be unenforceable, the rest continues to apply.
